Foodway.co.uk endeavours to deal with reputable third parties who provide a quality service, however foodway.co.uk accepts no responsibility or liability for the quality or quantity of any goods delivered by or collected from said third parties. It is the responsibility of the customer to thoroughly check the supplied goods before agreeing to pay for an order. All questions regarding goods shown on this Site should be directed to the partner restaurant. After you submit an order to us, we will give you an Order Number and send the details of this order in an email or via phone. If the restaurant is unable to fulfil your order you will receive an email or phone call stating that your order has been declined. Please make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address. All food preparation and deliveries are the sole responsibility of the restaurant accepting the order. Please be aware that the restaurant will do everything they can to meet the delivery time you specified, however delivery times may be affected by factors beyond their control and therefore cannot be guaranteed. We will inform you if we become aware of an unexpected delay. Incorrect personal details may lead to problems or delays in delivery, so please ensure that you have included your correct address (including postcode), email address and contact telephone number when ordering. FoodWay.co.uk reserves the right to make changes to these terms and conditions at any time and it is the responsibility of the site visitor/user to check here for the valid terms and conditions. All terms and conditions are valid up to the time of being published online. No material from the site may be copied, reproduced, republished, uploaded, posed, transmitted, or distributed in any way. You are not allowed to use this site for any purpose that is unlawful or prohibited by the terms and conditions. The delivery provider refers to the restaurant/takeaway/delivery shop from which you order your food through the Foodway.co.uk website. Foodway.co.uk provides customer with meals by linking them with our network of food retailers across the UK. We are not responsible for the quality of food received through our delivery providers, and any complaints, requests, or issues arising from the quality of food ordered, or any other issues, are to be directed to supplied restaurant. As our valued customer we can contact with restaurant’s management about complaint. Users are prohibited from making false ("hoax") delivery requests through our website. The use of cookies may be used to monitor I.P. addresses as stated in our privacy policy in order to blacklist any computers which foodway.co.uk suspects of being used to commit false delivery requests. foodway.co.uk reserves the right to seek compensation through legal action for any losses incurred as the result of hoax delivery requests and will prosecute to the full extent of the law. This right also applies to anyone using the foodway.co.uk 0800 FREEPHONE number to commit fraud or crimes. Calls may be recorded and monitored for security purposes. Foodway.co.uk accepts no liability for damages or losses incurred by the use or inability use this or affiliated websites. Foodway.co.uk reserves the right to cancel any delivery order or customer account, and refuse any special offer or promotion or request for amendments to orders without reason or prior consent. Items which are displayed as vegetarian, halal, spicy, containing nuts or otherwise described by the helpful descriptions may not be accurate. It is the responsibility of the user/visitor to seek assurance through contacting the restaurant owner direct (who's contact details will be apparent throughout the foodway.co.uk ordering process) to confirm the status of the item. It is the responsibility of the delivery provider and not foodway.co.uk to ensure that every care is taken to ensure the food matches its helpful description. Under any circumstances including but not limited to negligence will foodway.co.uk not accept any liability for losses or damages incurred resulting in either the correct or incorrect labelling of items. It is the responsibility of the delivery provider to make sure the details about their service appearing on the foodway.co.uk website(s) is correct. Foodway.co.uk always tries to keep as much information updated as possible. However, there may be sudden changes in regards to the opening hours, delivery times, accepted payments, prices or any other relevant information by the individual takeaways without prior notice. Foodway.co.uk provides a platform for individual shop owners to market online and it is their responsibility to ensure information is accurate and up to date. Foodway.co.uk takes no responsibility for food or other item's availability, price indescrepencies or innacuracies, or details pertaining to shop opening hours and individual shop's terms and conditions of service. You may be bound by the terms and conditions of delivery providers which are separate and unrelated to foodway.co.uk's terms and conditions. It is the responsibility of the user/visitor to make sure that they abide by those conditions. It is the responsibility of the user/visitor/customer to ensure that delivery address details are correct and detailed enough for the delivery driver to locate the address in adequate time. In the event that your address cannot be found, undelivered deliveries will be charged at full cost. By agreeing to our terms and conditions you agree to be added to our mailing list which we will use as your permission to contact you for but not limited to the following reasons; to inform you of updates to our terms and conditions of service, send order notifications, and promotional material. No employee or representative has authority to alter, modify or waive any provision of these terms and conditions. Members can track the progress of their orders by viewing their Order History. Age restricted products like Alcohol and Cigarettes Pursuant to the Licensing Act 1964, it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Cigarettes are not for sale to minors under the age of 16. Orders containing either alcohol or cigarettes can therefore not be accepted from minors. False Representing We do not tolerate anyone who uses false information to get referrals and attempt to earn points in this manner. Termination We reserve the right to decline a new registration, terminate your right to link to the Site, remove you as a user of this Site, and/or prevent any further use if you violate any of the Terms of Use. If we consider there to be a risk of liability or loss to us or our partner restaurants we may take any action deemed necessary to prevent such a liability or loss from occurring. Misuse With our dedicated security system, it is extremely difficult to manipulate data. If someone is caught manipulating or interfering with pointing system, we reserve the right to forfeit all earnings and possibly even ban the user from our network. Manipulating would include any of the following but not limited to: Interfering with our system to prevent optimum security and/or reliability. Creating any type of crawler, boot or any kind of program to automate the process of clicking or ordering. Any malicious act that may, in any way, interfere with our system. Foodway.co.uk reserves the right to change the pointing/affiliate system scheme at any time with or without advanced notice. This website will be governed by and construed in accordance with English law and any disputes relating to their disclaimer will be subject to the non-exclusive jurisdiction of the courts of England and Wales. Refund Only if the restaurant haven't started preparing your food yet; simply call our customer hotline on or use our Live Chat and we will cancel your order. Once the order has been accepted, it is still possible to cancel and receive a full refund. If you need to cancel the order because your plans have changed, call us right away and we let the restaurant know. This is because they will have probably already started cooking the food so they need to be informed of any cancellation as soon as possible. Well then cancel the order; if you have paid online, your payment will be refunded in full. If theres a problem and you decide you would rather to cancel the order, contact foodway.co.uk immediately. If, for some reason, the food is delivered unexpectedly, just refuse the order at the door. If you accept the food, but then realise that theres a problem with the order and you cant eat it, contact the restaurant and ask them to collect the food or to replace the food. Once you’ve done so, just let us know and so we can verify it and cancel the order in our system. If you’ve paid in cash, you should receive your refund at the door. If you paid online, we would issue your refund once you’ve notified us of the cancellation. We can only issue a full refund of an online payment if you dont accept your food, or if you have the restaurant to come and pick it up after you have received it. As long as you don’t keep the food (or throw it in the bin), Foodway.co.uk will always make sure your refund is issued right away. Leaflet promotions Any promotional discounts either offered on leaflets, tickets, printed vouchers or any other promotional materials or mediums are promoted for use once per customer and are subject to availablity and change at any time.
